Agreement to Terms

By accessing or using SfProxy's services, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any part of these terms, you may not use our services. These Terms constitute a legally binding agreement between you and Simona Mutinova (trading as SfProxy), a sole trader registered in the Czech Republic.

1. Service Description

SfProxy, operated by Simona Mutinova, provides proxy server services, including but not limited to mobile proxies and server (datacenter) proxies. Our services allow you to route your internet traffic through our proxy servers for various legitimate purposes.

2. Acceptable Use Policy

2.1 Permitted Uses

You may use our services for:

• Web scraping and data collection for legitimate business purposes
• SEO monitoring and competitive analysis
• Social media management and marketing
• Ad verification and brand protection
• Price comparison and market research
• Accessing geo-restricted content you are legally entitled to
• Privacy protection and anonymity

To use our services, you must:

• Be at least 18 years of age
• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized use

4. Payment Terms

4.1 Pricing

All prices are displayed in US Dollars (USD). We reserve the right to change pricing at any time, but price changes will not affect existing active subscriptions.

4.2 Payment Processing

Payments are processed securely through Stripe. By providing payment information, you authorize Simona Mutinova (trading as SfProxy) to charge the applicable fees to your payment method.

5. Service Level and Availability

5.1 Uptime Guarantee

We strive to maintain 99.9% uptime. Scheduled maintenance will be announced in advance when possible.

5.2 Service Modifications

We reserve the right to modify, suspend, or discontinue any aspect of our services with reasonable notice. Critical changes will be communicated via email.

6. Bandwidth and Usage

• All plans include unlimited bandwidth
• Excessive or abusive usage that affects service quality may be subject to review
• We reserve the right to throttle or suspend accounts engaged in abuse

7. Intellectual Property

All content, trademarks, and intellectual property on our website and in our services remain the property of Simona Mutinova (trading as SfProxy). You may not reproduce, distribute, or create derivative works without written permission.

8. Privacy and Data Protection

Your use of our services is governed by our Privacy Policy, which is fully compliant with the EU General Data Protection Regulation (GDPR) and Czech Act No. 110/2019 Coll. on Personal Data Processing. We do not log your browsing activity or traffic content.

9. Account Termination

9.1 By You

You may terminate your account at any time by contacting support. Refunds, if applicable, will be processed according to our Refund Policy.

9.2 By Us

We may suspend or terminate your account if you:

• Violate these Terms of Service
• Engage in prohibited activities
• Fail to pay applicable fees
• Provide false or misleading information
• Abuse our support or refund systems

We will make reasonable efforts to notify you before termination, except in cases of severe violations.

10. Disclaimers and Limitations of Liability

10.1 Service "As Is"

Our services are provided "as is" without warranties of any kind, either express or implied. We do not guarantee uninterrupted, error-free, or secure service.

10.2 Limitation of Liability

To the maximum extent permitted by applicable Czech and EU law, Simona Mutinova (trading as SfProxy) shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services. Our total liability is limited to the amount paid by you in the 3 months preceding the claim.

10.3 Third-Party Services

We are not responsible for the policies, practices, or content of third-party websites or services accessed through our proxies.

11. Indemnification

You agree to indemnify and hold harmless Simona Mutinova (trading as SfProxy) from any claims, damages, losses, or expenses arising from your use of our services, violation of these terms, or infringement of any third-party rights.

12. Compliance with Laws

You are solely responsible for ensuring your use of our services complies with all applicable laws and regulations in your jurisdiction. This includes but is not limited to:

• GDPR (EU General Data Protection Regulation)
• Czech Act No. 110/2019 Coll. on Personal Data Processing
• Czech Act No. 127/2005 Coll. on Electronic Communications
• Computer Fraud and Abuse Act (if in the US)

13. Governing Law and Dispute Resolution

13.1 Governing Law

These Terms are governed by the laws of the Czech Republic and applicable European Union regulations. Any matters not covered by these Terms shall be resolved in accordance with Czech Civil Code (Act No. 89/2012 Coll.) and relevant EU consumer protection directives.

13.2 Jurisdiction

Any disputes arising out of or in connection with these Terms shall be subject to the jurisdiction of the competent courts of the Czech Republic.

13.3 Out-of-Court Resolution

Consumer disputes may be submitted to the Czech Trade Inspection Authority (Česká obchodní inspekce, www.coi.cz) for out-of-court resolution.

14. Changes to Terms

We may update these Terms of Service from time to time. Significant changes will be communicated via email at least 30 days in advance. Your continued use of our services after changes take effect constitutes acceptance of the new terms.

15. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and Simona Mutinova (trading as SfProxy) regarding your use of our services.
